Grace & Co.-Conn., you requested a tariff classification ruling on anti-corrosive pigment. A sample of the product has been submitted for review and will be returned as requested. The product is described as a high performance anti-corrosion pigment, which is easily dispensable, non-toxic, and in the form of a white, odorless powder. The submitted documents indicate that the product at issue is mainly used for water-borne paint systems, general industrial coatings, maintenance and protective coating applications, and automotive paints. You have suggested that this product is correctly classified in subheading 3824.90.3900, Harmonized Tariff Schedule of the United States (HTSUS), as “…Mixtures of two or more inorganic compounds…” However, we have determined that this product is not a mixture of heading 3824 (HTSUS). The general rate of duty will be 3.1 percent ad valorem. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U.S. Environmental Protection Agency.
