Dear Ms. Vizcarra: In your letter dated May 10, 2012, and received in this office on July 3, 2012 you requested a tariff classification ruling. You submitted the following sample, which is being returned per your request: The Adult-Size Haunted Victor Costume is identified as item number 6748259. Although you state it consists of a coat with attached shirt and jabot, pants, and hat, the “attached shirt” is actually a dickey. It is made of 100% polyester and will be imported in various sizes (i.e. adult small, medium, and large). GRI 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods "shall be classified as if they consisted of the material or component which gives them their essential character." The coat imparts the essential character of the set. The coat has a dickey, faux pockets which provide some styling and is embellished with buttons and a chain. However, this coat is not well made. The coat has flimsy jagged raw edges on the hem and arms; the collar is raw with visible loose threads; the dickey, jabot and pocket edges are all raw; and the lapel flower is flimsily tacked and glued on the coat. The closure, which is secured with hook and loop tabs, has loose overlock stitching. The applicable subheading for the Haunted Victor Costume will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
