Dear Ms. Van Heuveln: In your letter dated June 8, 2012, you requested a tariff classification ruling. The samples are being returned to you as requested. Style 65200WM-A is an artificial pick which measures approximately 5 inches (H). The pick contains two metal rods that are twisted together and covered in paper. Small plastic rods are inserted into the metal rods and branch off in different directions. The pick is covered in glitter and round balls are glued to the plastics rods at various locations. Style 97975WMB-D is an artificial pick which measures approximately 8 ½ inches (H). The pick contains two metal rods that are twisted together and covered in paper. Small plastic rods are inserted into the metal rods and branch off in different directions. The pick is covered in glitter and round balls are glued to the plastics rods at various locations. You suggest the classification for Styles 65200WM-A and 97975WMB-D should be 3926.40.0000. We disagree with your proposed classification. The artificial picks are more specifically provided for in heading 6702 of Harmonized Tariff Schedule of the United States (HTSUS). The applicable subheading for Styles 65200WM-A and 97975WMB-D, will be 6702.10.2000, HTSUS, which provides for Artificial flowers, foliage and fruit and parts thereof; articles made of artificial flowers, foliage or fruit: Of plastics: Assembled by binding with flexible materials such as wire, paper, textile materials, or foil, or by gluing or by similar methods. The rate of duty will be 8.4%. Duty rates are provided for your convenience and are subject to change.
