In your letter you suggest classification under 6211.42.0056, HTS, as a woven garment. Because the garment is constructed of both knitted and woven components we apply GRI 3 (b), which states that garments will be classified by the component which gives them their essential character. The warp knitted lace like component of the garment imparts the essential character to the garment based on the nature of this material that provides a visual and significant decorative effect. We are returning your sample as requested.

The submitted sample, Style 058-0474, is a woman’s tank top. The external front panel is constructed of 68 percent cotton, 25 percent nylon and 7 percent rayon knit fabric.
