The item is a rectangular, open-topped bin measuring approximately 13” (l) x 11” (w) x 7 ½” (h). The sides and ends of the bin are constructed of evenly spaced, horizontal ¼” thick wooden slats. The bottom of the bin consists of a solid panel of wood. There is a removable, woven cotton textile liner that folds over the basket’s upper rim to the outside, and covers the upper 2 ½” of the bin. The Harmonized Tariff Schedule of the United States General Rule of Interpretation Harmonized Tariff Schedule of the United States (“HTSUS”) 3 (b) states as follows: (b ) Mixtures, composite goods consisting of different materials or made up of different components, and goods put up in sets for retail sale, which cannot be classified by reference to 3(a), shall be classified as if they consisted of the material or component which gives them their essential character, insofar as this criterion is applicable. The wooden storage bin is a composite good made up of different materials. General Rule of Interpretation 3(b), HTSUS, states that composite goods are to be classified according to the material that gives them their essential character. The essential character of the subject bin is imparted by the wood, which is the structural material that allows the item to function as a storage bin.

The ruling was requested on a wooden storage bin. A representative sample was submitted for our review.
