You submitted five samples. Style 1233220A is a sweatband made up of knit fabric with elastomeric filaments in the warp. The sweatband, measuring 1-1/2” wide and 9” in diameter, has a reflective rubber logo and the word “Run” glued to the front. Reflective threads also run around the band with rubber on the underside to help secure the sweatband to the head. The applicable subheading for sweatband style 1233220A will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. The four other samples are hairbands, all identified as style 1233091A. They are narrow hairbands used by athletes to keep their hair in place. The items measure approximately one half inch in width and are constructed of knit man-made fiber fabric with rubber logos on the underside to help secure them to the head. The applicable subheading for hairbands style 1233091A will be 6117.80.8500, HTSUS, which provides for “Other made up accessories, knitted or crocheted; knitted or crocheted parts of garments or of clothing accessories: other accessories: Other: headbands, ponytail holders and similar articles.” The duty rate will be 14.6 % ad valorem.
