Dear Ms. DeJager: In your letter dated December 2, 2011, you requested a tariff classification ruling. The samples submitted will be returned. Style 3189 is a full-fingered unisex work glove with a complete palm side, from fingertips to wrist, as well as an approximately 2 inch strip at the bottom of the gauntlet cuff, constructed of 100% cowhide leather. The inner layer of the glove, as well as the fourchettes, is a SuperFabric (HA110) composed of 38% polyester and 62% plastic. The back of the glove shell is a SuperFabric (HA603) composed of 43% polyester and 57% plastic. You state that each of the SuperFabrics has had guard plates applied using a screen printing process which produces a series of geometrical shapes that provides a high level of cut, puncture and abrasion resistance. The HexArmor logo appears on the back of the cuff. The leather palm imparts the essential character of the glove. The applicable subheading for Style 3189 will be 4203.29.1500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for articles of apparel and clothing accessories, of leather or of composition leather: gloves, mittens and mitts: leather gloves of horsehide or cowhide (except calfskin) leather: other: with fourchettes or sidewalls which, at a minimum, extend from fingertip to fingertip between each of the four fingers. The rate of duty will be 14% ad valorem. Duty rates are provided for your convenience and are subject to change.
