Grand Rapids, MI 49504 RE: The tariff classification of a plastic Easter treat pail from China Dear Mr. Morse: In your letter dated November 11, 2011, you requested a tariff classification ruling. The submitted sample is identified as an Easter treat pail, Item# 2705020. It is made of green plastic material and measures approximately 5½” in height by 7¾” in diameter. The pail features plastic stickers on the exterior surface that are designed with the printed images of Easter eggs. This item is designed to hold Easter candy and other gifts on Easter morning. Although not included with the submitted sample, a plastic handle will be attached to the top of the pail when it is actually sold and there are two plastic tabs located respectively on the top of two opposing sides of the submitted sample that will facilitate the attachment of the handle. As you requested, the sample will be returned to you. The applicable subheading for Item Number 2705020 will be 3924.10.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for tableware, kitchenware…of plastics: tableware and kitchenware: other. The rate of duty will be 3.4 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
