Dear Dai: In your letter dated June 13, 2011, you requested a tariff classification ruling. The item under consideration is the GFC106 Hurricane Candle Holder. A sample was submitted with your ruling request and will be returned to you. The submitted sample is a thick clear cylindrical glass article resembling a short pedestal or stem glass measuring approximately 6 inches tall with an outside diameter of 3¾ inches. The opening of the imported article is fitted for stabilizing a standard 3 inch diameter pillar style candle and measures approximately 4½ inches deep. The applicable subheading for the GFC106 Hurricane Candle Holder will be 9405.50.4000, HTSUS, which provides for “Lamps and lighting fittings…Non-electrical lamps and lighting fittings: Other: Other.” The general rate of duty will be 6 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
