Specifically, there is a backing fabric of warp knit construction that is composed of 100 percent polyester man-made fibers that has been bonded to an upper layer of 100 percent polyester fabric having a woven construction. This upper layer has been uniformly and visibly coated with a polyurethane plastics material (cellular). Finally, this polyurethane plastics layer has been partially flocked with nylon man-made fibers to produce an animal fur skin appearance. Your letter indicates that this material is not over 70 percent by weight of the polyurethane plastics portion.

Dear Ms. Berry: In your letter dated May 25, 2011, on behalf of Hancock Fabrics, Baldwyn, MS, you requested a tariff classification ruling. The instant sample, identified as style “Pleather MA03-1, consists of a material containing three distinct layers. Specifically, there is a backing fabric of warp knit construction that is composed of 100 percent polyester man-made fibers that has been bonded to an upper layer of 100 percent polyester fabric having a woven construction. This upper layer has been uniformly and visibly coated with a polyurethane plastics material (cellular).
