Dear Mr. Armour: In your letter dated June 3, 2011 you requested a tariff classification ruling. The products you plan to import are aluminum fence panel kits. These kits are comprised of 15 pickets, 3 rails, 1 post, 3 rods, grommets and screws and will be used in residential fencing applications. The pickets, rails, post and rods are made of aluminum alloy. You indicate that the kits will be shipped together unassembled and that each shipment will contain the correct number of components that after assembly will make complete fence panels. The applicable subheading for the aluminum fence panel kits will be 7610.90.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for aluminum structures (excluding pre-fabricated buildings of heading 9406) and parts of structures (for example, bridges and bridge- sections, towers, lattice masts, roofs, roofing frameworks, doors and windows and their frames and thresholds for doors, balustrades, pillars and columns); aluminum plates, rods, profiles, tubes and the like, prepared for use in structures, other, other, other.
