Product description
You submitted a sample of an Ultimate Party Animal costume, which consists of a textile top with the printed words, “Ultimate Party Animal”, shorts, a simian mask, a utility-type nylon belt that has slots for holding canned beverages, and one shot glass that are packaged together for retail sale as a set. GRI 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the top imparts the essential character of the set. The top is overwhelmingly flimsy, with a raw neck, loose stitched seams, a hook and loop tab closure, loose overlock stitched arms and hem and a raw closure edge.
