Dear Ms. Purvis: In your letter dated April 14, 2011, you requested a tariff classification ruling on behalf of your client, Creative Industries, LLC. A representative sample was included with your submission and will be retained by this office. The product to be imported is described as a “Non-Lighted” Baluster for use with deck railings. The baluster consists of a round, aluminum alloy (type 6063) tube that measures 26 inches in length with plastic connectors attached on both ends that will secure the baluster to the deck rails. The applicable subheading for the aluminum baluster will be 7610.90.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for aluminum structures (excluding pre-fabricated buildings of heading 9406) and parts of structures (for example, bridges and bridge- sections, towers, lattice masts, roofs, roofing frameworks, doors and windows and their frames and thresholds for doors, balustrades, pillars and columns); aluminum plates, rods, profiles, tubes and the like, prepared for use in structures, other, other, other. The rate of duty will be 5.7 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
