Dear Mr. Piatek: In your letter dated August 8, 2010, you requested a tariff classification ruling on behalf of your client, Xerebrus Inc. The merchandise under consideration is the Flare XM-1 Lamp. It is made of plastic and measures approximately 2½ inches wide by 3¼ inches high by 2½ inches deep. The Flare XM-1 features an LED (light emitting diode) lamp and reflector under a clear lens, and is powered by one “18500” size battery.
