Your product is described by you as an alcohol free hand cleaner “sanitizer” containing the aromatic surfactant benzalkonium chloride. Your sample consists of a spray applicator containing .69 oz. of the hand cleaner packaged with two additional refills. The product is not fragranced and does not contain any disinfectants. The applicable subheading for the alcohol free hand cleaner will be 3401.30.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Organic surface-active products and preparations for washing the skin, in the form of liquid or cream and put up for retail sale, whether or not containing soap: Containing any aromatic or modified aromatic surface-active agent. The rate of duty will be 4 percent ad valorem. Perfumery, cosmetic, and toiletry products are subject to the requirements of the Federal Food, Drug and Cosmetic Act, which are administered by the U.S. Food and Drug Administration.
