The diameter of the bowl across the top, as well as across the bottom, is 4 ¾”. The bowl is white and features a handle on each side. The value of the bowl is stated to be $2.60. Dear Mr. Victoria: In your letter dated November 13, 2009, you requested a tariff classification ruling. You have submitted samples of five porcelain bowls, Styles S10. Regarding the French onion soup bowl, it has been determined that, although referred to as a “bowl”, the article does not have the form of a bowl. Therefore, classification in both instances under subheading 6911.00.5200, Harmonized Tariff Schedule of the United States (HTSUS), is precluded. The applicable subheading for the five porcelain bowls will be 6911.10.8010, HTSUS, which provides for “Tableware, kitchenware, other household articles and toilet articles, of porcelain or china: Tableware and kitchenware: Other: Other: Other: Other, Suitable for food or drink contact.” The rate of duty will be 20.8% ad valorem. Duty rates are provided for your convenience and are subject to change.
