Dear Ms. Fuller: In your letter dated October 7, 2009, you requested a tariff classification ruling. The submitted sample will be retained by this office. A sample has been submitted of a hair-curler. The curler has a metal wire frame with a polypropylene mesh covering. This item is 4 inches wide and comes in three diameter sizes: 2 inch, 1 1/2 inches and 1 ¼ inches. A plastic pin of 3 ½ inches is included for each hair-curler to hold it in place. The applicable subheading for the hair curler will be 9615.90.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for "Combs, hair-slides and the like: hairpins, curling pins, curling grips, hair-curlers and the like, other than those of heading 8516, and parts thereof: Other: Nonthermic, nonornamental devices for curling the hair." The rate of duty will be 8.1% ad valorem. Duty rates are provided for your convenience and are subject to change.
