Dear Ms. Tsiavos: In your letter dated October 9, 2009, you requested a tariff classification ruling. Item number 9060, an Adult Classic Cape, and item number 9060H, which is the same item except packaged on a hanger with a color insert, are flimsy textile costumes. These items have the same construction as style number 9121, the Adult Vampire Cape, the subject of a preclassification, number PC I81706, dated May 9, 2002. The name of the costume, the style number, and the fabric’s construction are the only differences between this costume and the style previously classified. The cape is now constructed of 100% polyester knitted fabric, while the cape in PC I81706 was 100% polyester woven fabric.
