Dear Ms. Reagan: In your letter received September 30, 2009, you requested a tariff classification ruling. The sample, Style EZ 817, is an infant’s denim cotton shortall. The one-piece garment features a front bib rise, pants coverage at the legs and adjustable shoulder straps. The item will be imported in infant sizes 6 -24 months. The style is not classifiable in subheading 6209.20.5030 as you propose, because the lower garment portion covers the knee. The applicable subheading for Style EZ 817 will be 6209.20.5050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for babies’ garments and clothing accessories, of cotton: other, other, other. The rate of duty will be 9.3 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
