Dear Mr. Smithweiss: In your letter dated July 31, 2009, on behalf of DL Trading Ltd, you requested a tariff classification ruling The article is described as Polyamide-6,6 pellets containing 100% nylon-6,6 reprocessed from nylon scrap. The applicable subheading for the Polyamide -6,6 pellets reprocessed from nylon scrap will be 3908.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for polyamide-6,6 in primary forms. The rate of duty will be 6.3%, ad valorem. This merchandise maybe subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U. S. Environmental Protection Agency. Duty rates are provided for your convenience and are subject to change.
