The submitted sample is identified as a Plastic Table Skirt, sku# 1PSS4631. This item is made of polyethylene (PE) plastic material and measures 14 feet by 29 inches. It is green in color and has an adhesive-strip backing along the top edge which allows it to be attached around the perimeter of a table top, so that it will drape down to the floor, thereby concealing the base or legs of the table. As you requested, the sample will be returned to you. You suggested that this item is correctly classified in subheading 9505.90.4000. However, we do not agree that this item is correctly classified in the subheading that you have suggested. Although you claim that this item is transparent, we do not find this to be the case. In addition, we find that this item is durable enough to be reusable and is therefore considered to be a household furnishing. The applicable subheading for the table skirt will be 3924.90.1050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for … other household articles…of plastics: other: curtains and drapes, including panels and valances; napkins, table covers, mats, scarves, runners, doilies, centerpieces, antimacassars and furniture slipcovers; and like furnishings. The rate of duty will be 3.3 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
