This rechargeable, battery-operated combination, which is considered to be a composite machine, is imported with an AC-DC adapter, a remote control with bracket, a battery, a USB cable, and a user’s guide. This merchandise is considered to be a set for tariff classification purposes with the essential character being imparted by the composite machine: the digital photo frame and clock radio combination. Further, it is the opinion of this office that neither the function of the digital photo frame nor the function of the clock radio performs the principal function of this composite machine. Therefore, classification will be in accordance with General Rule of Interpretation 3(c), Harmonized tariff Schedule of the United States (HTSUS), which requires, in relevant part, that the merchandise is to be classified in the heading (in this instance, heading 8528, HTSUS) which occurs last in numerical order among those which equally merit consideration.
