Dear Ms. Lee: In your letter dated February 10, 2009, on behalf of Spencer Gifts, Inc., you requested a tariff classification ruling. The samples which you submitted are being returned as requested. Style W-2492-01 Pirate Costume Set consists of a dress, belt and scarf made of knit 100% polyester fabric. The sleeveless dress has a double flounce at the bottom and a tattered trim at the neckline. General Rule of Interpretation (GRI) 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale.
