Dear Mr. Rini: In your letter dated December 23, 2008, on behalf of Melissa & Doug LLC, you requested a tariff classification ruling. The submitted sample, identified as item #9078110631 and described as a child’s rain or inclement weather boot, is a waterproof boot that is approximately 8-inches in height. The boot covers the ankle but not the knee, has an outer sole and upper of rubber/plastics material and is assembled entirely by a molding process. The boot also has a textile material lining and the boot shaft features two molded-on rubber/plastic pull-up hoops.
