Dear Mr. Meyer: In your letter dated December 12, 2008, you requested a tariff classification ruling. No sample was provided, but you did provide an image of what appear to be multiple short cylinders in a box. You state: The article is a 2.0” long E52100 bearing quality steel rod with a precision outside diameter. Common uses are measuring hole sizes and depth, Go/NoGo gaging, and checking distance between holes in parts. Harmonized System Explanatory Note D-5 to its 90.17 states: Gauges without adjustable devices, used only for sizing parts or checking angles, forms, etc. (for example, plug gauges, ring gauges), are excluded (heading 90.31).
