Dear Ms. Jewett: In your letter dated November 18, 2008 you requested a tariff classification ruling. The merchandise under consideration is the No Battery Flashlight, style number HR-EM106. A sample of the flashlight was submitted with your ruling request. It is a self-powered flashlight measuring approximately 8 inches long by 2 inches in diameter at its widest points, with a cylindrical plastic housing designed to fit comfortably in the hand. At one end of the housing is a recessed LED (light emitting diode) bulb and reflector under a clear lens. Shaking the flashlight charges its internal nickel-hydrogen battery, and a 3-position on/off/blink selector switch located on the housing activates the LED bulb as a steady beam of light or blink mode.
