Dear Mr. Williams: In your letter dated October 27, 2008, you requested a tariff classification ruling. You have submitted a resume of Ryuichi Kakurezaki. He creates traditional Bizen ware sculptures. They are made of clay, produced in limited editions and are non functional. He has exhibited in various museums and galleries throughout the world and is recognized as a professional artist of the free fine arts. You will be importing his Bizen style flower vase with an estimate of $3500. The applicable subheading for sculptures by Ryuichi Kakurezaki will be 9703.00.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Original sculpture and statuary, in any material”. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change.
