Dear Mr. Franklin: In your letter dated October 28, 2008, you requested a tariff classification ruling. The sample which you submitted is being retained by this office. A sample has been submitted of a natural bristle brush consisting of 80% horse hair and 20% hog hair. This item is attached by means of a metal ferrule to a wood handle, approximately 6 to 8 inches in length. The width of the brushes varies from ½ inch wide to 4 inches wide in one inch increments. The manufacturer of the brush insists that this item is not appropriate as a paintbrush since horse hair is too soft to absorb and apply paint.
