The submitted photo depicts a 6” brown-shaped tombstone decorated with that a skull with its hands and feet trying to break out from the surface and the word “RIP” below the feet. The item will be used in the house as a decoration to help crate a scary environment for Halloween. The applicable subheading for a Wax Tombstone (no item #) will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
