Dear Ms. Stanczak: In your letter dated October 3, 2008, you requested a classification ruling. The sample submitted will be returned. Style L203 is referred to as a pair of women’s “Knee High Tights” and is constructed of 95% nylon and 5% spandex knit fabric. The footless stirrup styled knee-length hosiery has an elasticized hemmed rib-knit top and bottom, and features open heels. You state that the item measures 71 decitex. The applicable subheading for the merchandise will be will be 6115.96.9020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other "Panty hose, tights, stockings, socks and other hosiery, other: of synthetic fibers: other: other, other." The duty rate will be 14.6 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
