Dear Mr. Loew: In your letter dated September 19, 2008, you requested a classification ruling. Two representative samples were submitted which were identified as styles 5013 and 8001, respectively. The first item, style 5013, consists of a woven fabric that is composed of a 95% cotton/5% urethane elastic blend. This material has been lightly, yet visibly coated on one side with a perfluoroalkyl acrylate polymer adhesive which is believed to be a plastics material. You state that this material will be imported in 90-centimeter widths and weighs 160 grams per square meter. A removable paper release protects the adhesive surface and is considered to be packing for tariff purposes. The second item, style 8001, consists of a woven fabric that is composed of a 90% cotton/10% urethane elastic blend. It is dyed a light brown and, according to your correspondence, contains the following technical specifications: Warp: 21/cm-Weft 19/cm Number turns per meter warp and weft: 300 Warp and Weft Cotton yarn: 20’s/70denier Wt. of fabric: 190 g/m² The applicable subheading for style 5013, which we presume will be imported as piece goods, will be 5903.90.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for textile fabrics impregnated, coated, covered or laminated with plastics, … of cotton. The rate of duty will be 2.7 percent ad valorem. The applicable subheading for style 8001, which we presume will also be imported as roll goods, will be 5208.39.4090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for woven fabrics of cotton, containing 85 percent or more by weight of cotton, weighing not more than 200 g/m2, dyed, other fabrics, other, of number 42 or lower number, other. The duty rate will be 7 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
