According to literature found on your company’s website, EmbryoGlue® is formulated to first provide safe transfer of the embryo and then to support it through the various stages of implantation. It contains Hyaluronan, which assists in rapid diffusion with the viscous hyaluranon-rich uterine fluid. It contains Recombinant Human Albumin to ensure safety, efficacy and consistency. It also has nutrients, such as carbohydrates, amino acids, vitamins, etc., required to support later stage embryo development. Pharmaceutical grade Penicillin G is present as a preservative. You suggest that classification in subheading 3004.90.1000, Harmonized Tariff Schedule of the United States (HTSUS), may be correct. This subheading provides for “Medicaments…consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses…or in forms or packings for retail sale: Other: Containing antigens or hyaluronic acid or its sodium salt.” We respectfully disagree. This product is not a medicament. It is not used to treat or prevent a human or animal ailment. It is our opinion that EmbryoGlue® fits the description of heading 3821. It is designed, at least in part, to maintain the integrity and development of human cells during in vivo fertilization (IVF) transfer and implantation procedures and processes.
