Dear Ms. Boyer: In your letter dated September 15, 2008, on behalf of your client Craig Bachman, you requested a classification ruling. The submitted sample, identified as style Organza Mesh #1 is a dyed plain woven fabric composed of 100% nylon textured filament. There are 38 single yarns per centimeter in the warp and 26 single yarns per centimeter in the filling. The weight of this fabric is 27 g/m2. It will be imported in 24 inch square sheets and 24 inch X 10 yard rolls. Your correspondence indicates that this fabric will be used for wrapping flowers, making bows and Christmas tree decorations. The applicable subheading for this fabric will be 5407.42.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for woven fabrics of synthetic filament yarn, including woven fabrics obtained from materials of heading 5404, other woven fabrics, containing 85 percent or more by weight of filaments of nylon or other polyamides, dyed, weighing not more than 170 g/m2. The duty rate will be 14.9%. Duty rates are provided for your convenience and are subject to change.
