While not specified in your correspondence, this fabric has been lightly, yet visibly coated on one side with what appears to be a milky white acrylic plastics material, and, as such, we will rule accordingly. While this coating does not appear to comprise over 70 percent by weight of the total weight of the fabric, you write that the total weight of the material is 306 grams per square meter.

Box 2811 Bayamon, Puerto Rico 00960 RE: The tariff classification of a plastics coated upholstery fabric, from China. Dear Mr. Soler: In your letter dated September 8, 2008, you requested a classification ruling. The instant sample, which was identified as item HT5509RCOSM, consists of a woven fabric composed of 100 percent polyester man-made fibers. While not specified in your correspondence, this fabric has been lightly, yet visibly coated on one side with what appears to be a milky white acrylic plastics material, and, as such, we will rule accordingly. While this coating does not appear to comprise over 70 percent by weight of the total weight of the fabric, you write that the total weight of the material is 306 grams per square meter. The applicable subheading for the material will be 5903.90.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for textile fabrics impregnated, coated, covered or laminated with plastics, of man-made fibers, not over 70 percent by weight of plastic. The duty rate will be 7.5 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This merchandise falls within textile category 229. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. For current information regarding possible textile safeguard actions on goods from China and related issues, we refer you to the web site of the Office of Textiles and Apparel of the Department of Commerce at otexa.ita.doc.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). The holding set forth above applies only to the specific factual situation and merchandise description as identified in the ruling request. This position is clearly set forth in 19 CFR 177.9(b)(1). This section states that a ruling letter is issued on the assumption that all of the information furnished in connection with the ruling request and incorporated therein, either directly by reference, or by implication, is accurate and complete in every material respect. This ruling is being issued under the assumption that the subject goods, in their condition as imported into the United States, conform to the facts and the description as set forth both in the ruling request and in this ruling. In the even that the facts or merchandise are modified in any way, you should bring this to the attention of Customs and you should resubmit for a new ruling in accordance with 19 CFR 177.2. You should also be aware that the material facts described in the foregoing ruling may be subject to periodic verifications by Customs. A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
