Dear Mr. McCullough: In your letter dated August 14, 2008, on behalf of your client H&M Hennes & Mauritz, LP, you requested a classification ruling. The submitted sample, Style #207190 1338, is a woman nightgown constructed from 100% viscose knit fabric with 92% nylon and 8% elastane open-work fabric. The sleeveless nightgown extends from the neck to the mid-thigh area and features a V-neckline in front with a textile bow stitched at the center, elasticized adjustable shoulder straps, slits at both sides, and lace trim finishing the bottom. The garment also has lace trim all around the top of the garment. Based on its appearance, the garment is considered sleepwear and classified in heading 6108. We are returning your sample as you requested. The applicable subheading for the nightgown, Style 207190 1338, will be 6108.32.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women's knit nightdresses, of cotton, women’s. The rate of duty will be 16% ad valorem. Duty rates are provided for your convenience and are subject to change.
