You have submitted a sample of a "Ladies Ellie Waspie," style 646550 1336, a waist cincher (corset) made up of 88% nylon and 12% spandex knitted net fabric. The garment features two front vertical stays on either side of the three front panels which measure approximately 7 inches and approximately 6 and 3/4 inches respectively. The garment also has two back vertical stays that measure approximately 6 and 1/4 inches. The eleven-panel garment also features a triple row of nine adjustable hook and eye closures at the center rear of the garment. In addition, the three front center panels feature two-ply construction; the second ply is a type of powernet fabric that resists both the horizontal and vertical stretch. The two panels on either side of the rear closure are made of two-ply construction as well. An elasticized band is featured on the inner top and bottom of the garment, which helps to keep the garment in place on the wearer. A decorative satin bow is located on the center front top of the garment.

Dear Mr. McCullough: In your letter dated August 14, 2008, you requested a classification ruling, on behalf of your client, H&M Hennes & Mauritz LP. The sample will be returned to you as requested. You have submitted a sample of a "Ladies Ellie Waspie," style 646550 1336, a waist cincher (corset) made up of 88% nylon and 12% spandex knitted net fabric. The garment features two front vertical stays on either side of the three front panels which measure approximately 7 inches and approximately 6 and 3/4 inches respectively.
