Box 20850 Fountain Valley, CA 92728-0850 RE: The tariff classification of a steel fastener from South Korea. Dear Ms. Stacey: This replaces Ruling Number N034007, dated July 31, 2008, which contained a clerical error. The tariff number that was provided within the ruling was valid through June 30, 2008. On July 1, 2008, the classification for steel studs was changed. A complete corrected ruling follows. In your letter dated July 16, 2008, you requested a tariff classification ruling. The sample which you have submitted was retained by this office. You have described the item as a steel bolt, part number 62492 2E000. It measures more than 6 mm in diameter and is approximately 4 inches long. It is threaded at both ends and the center, with approximately 1” that is not threaded, has a captured floating washer. Approximately 2 ¾” from the one end of the fastener is a hex flange head and protruding approximately ¾” from the head is the other threaded portion of the fastener. You state that the purpose of this fastener is to connect the stay and the bushing to the cross member. The threaded protuberance then connects to the body of the vehicle. The applicable subheading for the steel bolt, part number 62492 2E000, will be 7318.15.5090, HTSUS, which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers (including spring washers) and similar articles, of iron or steel: threaded articles: other screws and bolts, whether or not with their nuts or washers: studs: other, other. The duty rate will be free. Consideration was given to classifying this item as a screw within subheading 7318.15.8065, as you suggested, however, this product functions as a stud. It anchors a bushing and stay in place and leaves a threaded protuberance to allow the cross member to be fastened to the body of the vehicle. Duty rates are provided for your convenience and are subject to change.
