Dear Mr. Liu: In your letter dated August 6, 2008, you requested a tariff classification ruling on behalf of K. J. Sportswear. As requested, your sample will be returned. Style M640DABS, “Men’s Billabong Pullover,” is a men’s sweatshirt constructed from 80% cotton, 20% polyester, finely knit fabric that is napped on the inside surface. The garment has an all-over screen print design and features a self-fabric hood lined with sherpa pile fabric; a drawstring on the hood; long sleeves with rib knit cuffs; a large appliqué across the chest; a pouch pocket below the waist; and a rib knit bottom. The applicable subheading for Style M640DABS will be 6110.20.2040, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: sweatshirts: men's or boys'. The rate of duty is 16.5% ad valorem. Duty rates are provided for your convenience and are subject to change.
