Dear Mr. Rizner: In your letter dated July 23, 2008, you requested a tariff classification ruling. As requested, your sample will be returned. Style 1010 “Wicking / Antimicrobial T-shirt” is a men’s T-shirt constructed from 100% polyester, finely knit interlock fabric. Style 1010 features a self-fabric crew neckline; short, hemmed sleeves; and a straight, hemmed bottom. Style 1010 will be imported in Men’s sizes S - 3XL. The same garment will be imported in Boys’ (Youth) sizes S - L as Style 1011. The applicable subheading for Style 1010 will be 6109.90.1007, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of other textile materials: of man-made fibers: men’s or boys’: T-shirts: men’s. The rate of duty is 32% ad valorem. The applicable subheading for Style 1011 will be 6109.90.1009, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of other textile materials: of man-made fibers: men’s or boys’: T-shirts: boys’. The rate of duty is 32% ad valorem. Duty rates are provided for your convenience and are subject to change.
