Box 370080 Milwaukee, WI 53237-0080 RE: The tariff classification and marking of kitchen timers from China Dear Mr. Gardenier: In your letter dated July 23, 2008, on behalf of Tailor Made Products, you requested a tariff classification ruling. A sample of the kitchen timer was submitted with the ruling letter and is being returned as you requested. The article which you refer to as a mechanical kitchen timer is a wind up kitchen timer that requires no batteries. The kitchen timer features a circular face and a knob for setting the timer. The timer is calibrated from zero to sixty minutes. Turning the knob clockwise to the predetermined number of minutes sets the timer. The timer is packaged in a blister pack with a cardboard backing. The applicable subheading for kitchen timer will be 9106.90.8500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for time of day recording apparatus and apparatus for measuring, recording or otherwise indicating intervals of time, with clock or watch movement or with synchronous motor; other; other; other; other. The rate of duty will be 15 cents each plus 2.3 percent ad valorem plus 0.8 cents per jewel. You have also requested a marking ruling on the timer. The sample of the kitchen timer is marked with “Made in China” on the back of the timer. Additionally, the retail packaging is marked with “Made in China”. Based on the submitted sample the marking of the imported kitchen timer meets the requirements of 19 U.S.C. 1304 and 19 CFR Part 134. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
