Sierra Highway, #4617 Acton, CA 93510 RE: The tariff classification of a woman’s dress from China Dear Mr. Gould: In your letter dated July 25, 2008 you requested a tariff classification ruling on behalf of L’Koral LLC. We are returning your sample as per your request. The submitted sample, style ED441WS172, is a woman’s dress. The dress is constructed from 95% rayon 5% spandex knit fabric. The garment features a mock turtleneck neckline with, short sleeves and a hemmed garment bottom. The dress extends to the mid-thigh. The applicable subheading for style ED441WS172 will be 6104.43.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear), knitted or crocheted: dresses: of synthetic fibers: other: women’s. The rate of duty will be 16% ad valorem. Style ED441WS172 falls within textile category designation 636.
