The submitted sample is identified as item 128581 “2 piece woven kitchen towel set.” Both towels are made from 100 percent cotton woven fabric. One towel is a solid color and the fabric is of a waffle weave construction. It measures 15.5 x 24.5 inches. The second towel is of a waffle weave construction with a 5.5 inch wide center jacquard woven stripe. The jacquard stripe contains the words milk and cookies. It measures 15.5 x 25.5 inches. The edges of the towels are hemmed. In your letter you refer to the item 128581 as a kitchen towel set. The Explanatory Notes, which constitute the official interpretation of the Harmonized Tariff Schedule of the United States at the international level, state in Note (X) to Rule 3 (b) that the term "goods put up in sets for retail sale" means goods which: consist of at least two different articles which are prima facie, classifiable in different headings; consist of products or articles put up together to meet a particular need or carry out a specific activity; (c) are put up in a manner suitable for sale directly to users without repacking. The towels fall within the same subheading. Therefore, the towels are not classifiable as a set and each towel is classified separately.

The second towel falls within textile category designation 363.
