The tariff classification of women’s sleep bottoms from China

Customs Brokers & Freight Forwarders 4433 Woodson Road St. Louis, MO 63134 RE: The tariff classification of women’s sleep bottoms from China Dear Sir or Madam: In your letter dated June 18, 2008, you requested a classification ruling on behalf of Miss Elaine, Inc. Your samples will be returned. The submitted samples are women’s sleep bottoms constructed from 100% cotton woven fabric. Style #90493/90495 features an elasticized drawstring waist, capri length legs and side vents. Style #91493 features an elasticized waist, short legs and side vents. You have indicated that these garments will be sold in the sleepwear department and are part of a mix and match sale concept. Based on their appearance and the manner in which they will be marketed, the garments are considered sleepwear. The applicable subheading for both styles will be 6208.91.3010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles: other: of cotton: other: women’s. The duty rate will be 11.2 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. Both styles fall within textile category 352. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
