Dear Mr. Ching: In your letter dated June 9, 2008, you requested a classification ruling. Your sample is being returned as requested. The submitted sample, style 2351, is a woman’s cape that reaches the waist and is constructed from 55% acrylic, 33% polyester, 8% wool, 4% other fiber knit fabric. The cape features a wide pointed ribbed collar, and a full front opening with a button and snap closure. There are button closures on the left and right bottom hem that may be used as openings for the arm. The placket and bottom are finished with self-fabric capping. The applicable subheading for the cape will be 6102.30.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s capes, knitted, other than those of heading 6104: of man made fibers: other: women’s. The duty rate will be 28.2% ad valorem. Duty rates are provided for your convenience and are subject to change.
