Dear Mr. Harris: In your letter dated May 20, 2008, written on behalf of your client Global Textile Alliance, Inc. you requested a classification ruling. The submitted sample is identified as style “Obi”. It is a twill woven fabric composed of 55.5% textured filament polyester and 44.5 % polyester staple yarn. It is composed of yarns of different colors. It contains 53 single yarns per centimeter in the warp and 18 single yarns per centimeter in the filling. This merchandise weighs 169.8g/m2 and will be imported in 140 centimeter widths. Your correspondence indicates that this fabric will be used as upholstery. Your letter of inquiry states it is your opinion that this woven fabric would be classified under heading 5515.12.0040 of the Harmonized Tariff Schedule of the United States (HTSUS). We disagree with your proposed classification. Laboratory analysis indicates that this fabric is composed primarily of polyester filament yarn. The applicable subheading for this fabric will be 5407.93.2050, HTSUS, which provides for woven fabrics of synthetic filament yarn, including woven fabrics obtained from materials of heading 5404, other woven fabrics, of yarns of different colors, other, other, other, satin weave or twill weave. The duty rate will be 12%. Duty rates are provided for your convenience and are subject to change.
