N029082 June 4, 2008 CLA-2-56:OT:RR:NC:N3:351 CATEGORY: Classification TARIFF NO.: 5609.00.3000 Karen Keeling Keeling Consulting Company 14312 Gholson Road Waco, TX 76705 RE: The tariff classification of bullion fringe and brush fringe from China Dear Ms. Keeling: In your letter dated May 7, 2008, you requested a tariff classification ruling on behalf of your client, Hobby Lobby Stores, of Oklahoma City, Oklahoma. You submitted three (3) samples. Item Number 378562 is identified as bullion fringe that is constructed of 100% rayon yarns. The yarns are twisted into cordage and the cords are twisted to form a 4” fringe that is held at the top with what you state are knit stitches. Item Number 499160 is identified as brush fringe that is constructed of 65% viscose and 35% rayon yarns. It appears to have been formed in a two-sided operation with what you call knit stitches at both edges with loose yarns running 3” across; the item thus created is then cut down the middle, creating two 1½” fringes, each bound on one edge with the knit stitches. The applicable subheading for the bullion fringe and the brush fringe will be 5609.00.3000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for articles of cordage not elsewhere specified, of man-made fibers. The duty rate will be 4.4% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. Your inquiry does not provide enough information for us to give a classification ruling on Item Number 499152 (gimp trim of 100% rayon). Your request for a classification ruling should include an explanation of how the cordage is attached. Is it sewn on or is it attached during the knitting process? When this information is available, you may wish to consider resubmission of your request. We are retaining the samples. If you decide to resubmit your request, please include all of the material that we have returned to you, including a copy of this letter. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
