The sample will be returned to you as you requested. The product is a small rectangular basket with a handle, measuring approximately 4” x 3 ¼” x 3 ½” high (7 ½” high, including the handle). It is constructed of interwoven plastic monofilaments and strip-like extrusions having a cross section that resembles multiple flattened tubes. The bottom, vertical sides and top and bottom rims of the basket are composed of blue monofilaments approximately 2 mm in diameter. The horizontal sides of the basket are composed of green, purple and pink strip-like extrusions, of various widths (7 mm, 9 mm and 15 mm). The handle is composed of a bamboo strip covered with pink and blue strip-like plastic extrusions.

Lauderdale, FL 33301 RE: The tariff classification of a woven vinyl basket from China Dear Mr. Crago: In your letter dated May 8, 2008 you requested a tariff classification ruling. A sample of the product to be classified, identified as the “Vinyl Easter Basket, with Handle,” item # A081BA01009, was submitted. The sample will be returned to you as you requested. The product is a small rectangular basket with a handle, measuring approximately 4” x 3 ¼” x 3 ½” high (7 ½” high, including the handle). It is constructed of interwoven plastic monofilaments and strip-like extrusions having a cross section that resembles multiple flattened tubes. The bottom, vertical sides and top and bottom rims of the basket are composed of blue monofilaments approximately 2 mm in diameter. The horizontal sides of the basket are composed of green, purple and pink strip-like extrusions, of various widths (7 mm, 9 mm and 15 mm). The handle is composed of a bamboo strip covered with pink and blue strip-like plastic extrusions. The applicable subheading for the “Vinyl Easter Basket, with Handle,” item # A081BA01009, will be 4602.90.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: Basketwork, wickerwork and other articles, made directly to shape from plaiting materials or made up from articles of heading 4601: Other (than of vegetable materials). The rate of duty will be 3.5 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
