You inquired if the “Flip Out Tray” could be classified as furniture in heading 9403, Harmonized Tariff Schedule of the United States (HTSUS). However, since the product is designed for use in bed and not specifically to stand on the floor, it is not classifiable as furniture.

The ruling was requested on a product identified as the “Flip Out Tray.” It is described as a large surface area with folding legs that can be used in bed, in front of the TV and for doing homework. A sample of the product, finished in white with multi colored letters and numbers along the borders, was submitted. The product will be finished in various colors, design and patterns. The sample consists of a flat rectangular surface with rounded corners measuring approximately 21 ½” long x 11 ¾” wide x ½” thick. It is made of wood with a plastic finish on the top surface and around the edges. Four 11” long folding metal legs are screwed into the bottom. The product is a composite good composed of different materials.
