J4S RE: The tariff classification of a woman’s pajama set from China Dear Ms. Hawley: In your letter dated May 13, 2008 you requested a classification ruling for a woman’s pajama set. The submitted sample, Style 77030JRF8, is a junior sized woman’s pajama set constructed from 100 percent cotton knit fabric. The set is composed of a top and pants. The top features a rounded neckline, a gathering above the bust, a screen printed design on the chest area and left sleeve, ¾ length cuffed sleeves and a hemmed bottom. The pants feature a wide elasticized waistband with grommets and a decorative lace, a back pocket with a screen print design and cuffed leg openings. Although you have described the garment as sleepwear, the appearance is ambiguous and does not clearly demonstrate its use as such. The rate of duty will be 8.5% ad valorem. Duty rates are provided for your convenience and are subject to change.
