Dear Mr. Crago: In your letter dated May 6, 2008, you requested a tariff classification ruling. You have submitted a sample of a plant stand, item number A026BA01372. It is a 3 tier stand with coconut liners. It is made of iron, stands on the floor (60” in height) and will be used in the home to hold three plants. The applicable subheading for the plant stand will be 9403.20.0015, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other metal furniture, Household: Other”. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
